6 June Hearings
We were notified of some 6 June hearings for bond modifications/reductions. These hearings will be presided over by Judge Thomas “Felon’s Friend” Hughston. Settle in for a long read and let’s review a few of them.
First up is Lavorieo Gathers. On 26 April he was charged with two counts of Unlawful Carrying of a Pistol and two counts of Unlawful Possession of a Pistol. His total bond was set at $30,000. Gathers bonded out of jail on May 3rd.
On May 17th Gathers was arrested again on a charge of Unlawful Carrying of a Pistol. His bond on that charge was set at $20,000.
Since a bond judge didn’t take advantage of the new law that says they don’t have to set a bond for repeat offenders already out on bond the 9th Circuit Solicitor has had to file a motion for bond modification on the four charges from April. If the 9th Circuit were a decent court system with decent judges we would expect to see those four bonds revoked. The way things actually are in the 9th Circuit don’t give us much hope that will happen, even considering Gathers’ criminal history.
2007 Charges:
Pointing and Presenting a Firearm - Dismissed by the 9th Circuit Solicitor.
Unlawful Carrying of a Pistol - Pled guilty. Sentenced by Judge Thomas “Felon’s Friend” Hughston to 1 year, suspended on service of 60 days and 1 year probation.
Assault on Police - Pled guilty. Sentenced by Judge Deadra Jefferson to a YOA term not to exceed 5 years.
Assault on Police - Dismissed by the 9th Circuit Solicitor.
Assault & Battery High & Aggravated - Dismissed at preliminary hearing.
Attempt to Disarm a Police Officer - Dismissed by the 9th Circuit Solicitor. Because, why send a message that is a bad thing?
PWID Crack Cocaine - Reduced to Possession of Crack by the 9th Circuit Solicitor. Sentenced to a YOA term not exceed 3 years, concurrent.
PWID Crack Near a School - Dismissed at preliminary hearing.
Gathers didn’t actually do much time in prison. He was sentenced to those YOA terms in March of 2009. He was arrested again six months later.
2009 Charges:
3rd Offense Possession of Crack - Pled guilty. Sentenced by Judge Roger Young to 30 months.
2010 Charges:
Pointing & Presenting a Firearm - Pled guilty. Sentenced by Judge Roger Young to 30 months, concurrent with the sentence above.
Unlawful Carrying of a Pistol - Dismissed by the 9th Circuit Solicitor.
2011 Charges:
Gathers went to trial in April 2014 on 2011 charges of Possession of a Weapon During a Violent Crime and two counts of Armed Robbery. You can read about the offense HERE. A jury found Gathers not guilty. We won’t even comment on that other than to say, if you sat on that jury and would like to explain that decision, shoot us an email via the contact page.

Let’s move on to another bond modification/revocation requested by the 9th Circuit Solicitor. This one is on Joshua Lee Frazier, aka Joshua Lee Frasier. In June of 2013 he was charged with 2nd Offense Criminal Domestic Violence and given a $10,000 bond. He bonded out on June 5th. On August 24th he was arrested again and charged with Trafficking Ecstasy and Possession of Narcotics. His total bond was set at $55,000. Frazier bonded out on August 29th. On September 12th he was charged with Possession of Ecstasy and given a $5,000 bond.
Those bond judges just don’t get it, do they?
Guess what? Frazier failed to appear in court for any of the above charges and bench warrants have been issued. Actually, the record tells us he failed to appear more than once, bench warrants were issued more than once, and our system kept releasing him so he could fail to appear yet again.
Frazier is now a fugitive from justice and was directly indicted on April 22nd on a charge of PWID Marijuana.
Maybe a review of his criminal history in Charleston County is in order.
2004 Charges:
Grand Larceny - Dismissed at the request of the victim.
Resisting - Dismissed by the 9th Circuit Solicitor because Frazier was in jail somewhere else.
1st Degree Burglary - Dismissed by the 9th Circuit Solicitor.
1st Degree Burglary - Reduced to 2nd Degree Burglary by the 9th Circuit Solicitor. Sentenced by Judge Deadra Jefferson to 10 years.
False Report of a Felony - Pled guilty. Sentenced to 5 years, concurrent.
2007 Charges:
Armed Robbery - Reduced to Strong Arm Robbery by the 9th Circuit Solicitor. Sentenced to 10 years, concurrent.
1st Degree Burglary - Reduced to 2nd Degree Burglary (Violent) by the 9th Circuit Solicitor. Sentenced to 10 years, concurrent.
Possession of a Weapon During a Violent Crime - Dismissed by the 9th Circuit Solicitor.
Sentenced to 10 years in 2008 and arrested again 5 years later in 2013. Truth in sentencing? Nope.
Here is a plea from Joshua Frazier’s mommy for someone to write to her boy while he was in the Charleston County jail.
The next thug up for a bond modification is Tyrie Grant, aka Tyree Grant. He has been in jail since last October with a total bond of $100,000 on charges of PWID Crack, Possession of Crack Near a School, PWID Marijuana and PWID Marijuana Near a School. Grant wants a bond reduction so he can get out of jail and get back to his drug dealing enterprise.
An examination of Grant’s history might help us decide if he should get a bond reduction.
2002 Charges:
Failure to Stop for Blue Light - Pled guilty. Sentenced by Judge Deadra Jefferson to 1 year, suspended in favor of 2 years probation.
Murder - Dismissed at preliminary hearing for “no probable cause”. Here is a brief article on the charge.
2nd Degree Lynching - Reduced to Simple Assault by the 9th Circuit Solicitor. Sentenced to 30 days.
2003 Charges:
Probation Violation
Possession of Crack Cocaine 1st Offense - Pled guilty. Sententeced by Judge Perry Buckner to 3 years, suspended in favor of 2 years probation.
Possession of a Firearm During a Violent Crime - Dismissed by the 9th Circuit Solicitor because the victim and Grant were both locked up.
ABWIK - Dismissed. See above.
Attempted Armed Robbery - Dismissed. See above.
2005 Charges:
Probation Violation
2007 Charges:
Unlawful Carrying of a Pistol - Dismissed by the 9th Circuit Solicitor.
2010 Charges:
Distribution of Crack and Distribution of Crack Near a School - Dismissed at preliminary hearing because the arresting officer did not show up.
At the time he was arrested in October, Grant was free on bond on other pending charges from 2013. To date, there has been no effort by the 9th Circuit Solicitor to revoke those bonds.
2013 Charges:
PWID Marijuana - Pending. Free on a $25,000 bond.
PWID Crack - Pending. Free on a $25,000 bond.
PWID Marijuana - Pending. Free on a $5,000 bond.
So, citizens, is Tyrie Grant deserving a bond reduction? We think not.
