Benjamin Lavon Smalls

Charleston police have charged Benjamin Lavon Smalls with a 29 January armed robbery at Plantation Oaks Apartments in West Ashley.  Smalls and an as yet unnamed cohort robbed a man at gunpoint for his cell phone and car keys. They then stole the victim’s car. Let’s review the criminal history of this twenty-three old thug from Lincolnville.

2008 Charges:

Unlawful Possession of a Pistol – Sentenced by Judge Thomas “Felon’s Friend” Hughston to eight months.

Pointing & Presenting a Firearm – Dismissed by the 9th Circuit Solicitor’s Office, even though Smalls had already failed to appear on the charge and a bench warrant had to be issued.

2010 Charges:

Possession of Crack Cocaine – Pending – Free on a $5,000 bond.

2011 Charges:

Armed Robbery – Pending. Initially released in March of 2012 on a bond of $50,000.

Possession of a Weapon During a Violent Crime – Pending. Initially released in March of 2012 on a bond of $25,000.

Smalls’ bond was apparently revoked in May of 2012. There was a motion to set bond again in February 2013. Smalls bonded out again in March of 2013. Judge Stephanie McDonald once again set bond in the total amount of $75,000 in December of 2013.

The database at the Charleston County jail shows Smalls was locked up there from May of 2012 through December of 2013.

2013 Charges:

3rd Degree Assault & Battery – Pled guilty before Judge David Coker. Sentenced to a 30 day jail term, consecutive to the incarceration above pending a bond reconsideration.

2014 Charges:

Possession of a Stolen Motor Vehicle – Pending – free on a $25,000 bond.

There is a chance this charge is related the armed robbery charges Smalls now faces.

There you have it, folks. Another repeat offender thug who keeps getting out of jail on bond while he has multiple felony cases pending. Our bond system is more of a work release program for criminals, isn’t it? Keep releasing them on bond, time after time, so they can go back to work victimizing others.
